IMPORTANT TAX INFORMATION
Understanding the 3% withholding.
When a non-resident sells a Spanish property, the purchaser is generally required to withhold 3% of the purchase price and pay it to the Spanish tax authorities on account of the seller’s potential capital gains tax liability.
This amount is credited against the seller’s final tax calculation. A separate tax return must also be filed within the applicable statutory deadline after completion.
Tax rules and requirements may change; individual advice should be obtained for each sale.
